OpequeGlass  sells digital products, including WordPress plugins and software licenses, through our website at https://opequeglass.com. Because our products are digital and delivered instantly, our refund policy differs from policies for physical goods.
By purchasing from OpequeGlass, you agree to the terms of this Refund and Return Policy. If you do not agree, please do not complete your purchase.

1. Nature of Our Products

All products sold by OpequeGlass are digital downloads and software licenses. This includes:
  • Dokan Conditional Category Attributes plugin
  • Any future WordPress plugins, extensions, or add-ons
  • Software license keys and activation credentials
Important: No physical items are shipped. All products are delivered electronically via download links and license keys sent to your email address upon successful payment.

2. Paddle as Merchant of Record

All purchases are processed by Paddle.com Market Ltd ("Paddle"), our exclusive Merchant of Record. Paddle handles:
  • Payment processing
  • Tax collection and remittance
  • Invoice generation
  • Initial refund processing
When you request a refund, Paddle processes the transaction reversal on our behalf. Refund eligibility is determined by OpequeGlass in accordance with this policy, but the actual refund transaction is executed by Paddle to your original payment method.

3. Refund Eligibility

3.1 Eligibility Criteria

We offer refunds under the following conditions:

3.2 Product Requirements

Before purchasing, you are responsible for verifying that your system meets the product requirements. Our plugins require:
  • WordPress (version specified on product page)
  • WooCommerce (version specified on product page)
  • Dokan Multivendor (where applicable)
  • A compatible hosting environment (PHP version, MySQL, etc.)
Refunds will not be granted for compatibility issues caused by:
  • Outdated WordPress, WooCommerce, or Dokan installations
  • Unsupported hosting environments
  • Conflicts with third-party themes or plugins not explicitly supported
  • Custom code modifications on your site

4. Non-Refundable Circumstances

We do not offer refunds in the following situations:
  1. Change of Mind: You decided you no longer want the product after downloading or activating it
  2. Failure to Read Description: You did not review the product features, requirements, or compatibility information before purchasing
  3. Lack of Technical Expertise: You do not possess the technical knowledge to install or configure the plugin
  4. Third-Party Conflicts: Issues caused by incompatible themes, plugins, or customizations not related to our product
  5. Abuse of License: You have used the license key to activate the product on multiple sites beyond the allowed limit
  6. Chargeback Abuse: You file a chargeback or dispute with your bank before contacting us for support
  7. Resale or Transfer: You purchased the license for resale or have transferred it to another party

5. Refund Process

5.1 How to Request a Refund

To request a refund, contact us within the eligible timeframe:

Your refund request must include:
  • Your full name and email address used for the purchase
  • Order number or transaction ID (from your Paddle receipt)
  • Reason for the refund request
  • Description of the issue (if applicable)

5.2 Refund Review Process

  1. Acknowledgment: We will acknowledge your refund request within 2 business days
  2. Review: We will review your request against this policy and may request additional information
  3. Decision: We will notify you of our decision within 5 business days
  4. Processing: If approved, Paddle will process the refund to your original payment method within 5–10 business days (depending on your bank or payment provider)

5.3 License Deactivation

If a refund is approved for a plugin purchase:
  • Your license key will be revoked and deactivated immediately
  • You must uninstall and delete the plugin from your website(s)
  • Continued use of the plugin after refund constitutes software piracy and may result in legal action
  • Any future updates or support will be terminated

6. Partial Refunds and Store Credit

In certain situations, we may offer alternatives to a full refund:
  • Partial Refund: If you experienced a minor issue that was resolved but still seek compensation
  • Store Credit: Credit toward future purchases on OpequeGlass
  • Product Exchange: Exchange for a different OpequeGlass product of equal or lesser value
These options are offered at our sole discretion and require mutual agreement.

10. User Conduct and Prohibited Activities

You agree not to use the Site or Products to:
  • Violate any applicable local, national, or international law or regulation
  • Infringe upon or violate the intellectual property rights of OpequeGlass or any third party
  • Transmit worms, viruses, malware, or any code of a destructive nature
  • Attempt to gain unauthorized access to our servers, systems, or licensing infrastructure
  • Engage in fraudulent transactions or payment disputes without first contacting us
  • Harass, abuse, or harm another person, including our staff or other customers
  • Interfere with or disrupt the integrity or performance of the Site or Plugin
  • No entity is permited to redistribute or reuse our system architecture

11. Termination

11.1 Termination by You

You may terminate your use of the Products at any time by:
  • Uninstalling the Plugin from your website(s)
  • Deleting all copies of the Plugin from your systems
  • Ceasing all use of the License Key

11.2 Termination by OpequeGlass

We may suspend or terminate your license, account, and access to the Site immediately, without prior notice or liability, if:
  • You breach any provision of these Terms
  • You engage in fraudulent payment activity or chargeback abuse
  • You redistribute, resell, or share your License Key
  • You use the Plugin for illegal or unauthorized purposes
  • We are required to do so by law
Upon termination:
  • All licenses granted to you will cease immediately
  • You must uninstall and delete all copies of the Plugin
  • You will not be entitled to any refund except as required by applicable law or our Refund Policy

11.3 Survival

Provisions that by their nature should survive termination shall survive, including but not limited to: Intellectual Property, Limitation of Liability, Indemnification, and Governing Law.

 

 

12. Disclaimers and Warranties

12.1 "As Is" Basis

The Products and Site are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

12.2 Disclaimer of Warranties

To the fullest extent permitted by law, OpequeGlass disclaims all warranties, including but not limited to:
  • Merchantability: We do not warrant that the Products will meet your specific requirements
  • Fitness for Purpose: We do not warrant that the Products will be compatible with every hosting environment or third-party extension
  • Uninterrupted Service: We do not warrant that the Site or licensing servers will be available at all times without interruption
  • Error-Free: We do not warrant that the Products will be completely free of bugs or errors
  • Security: While we implement security measures, we do not warrant that the Site or Products are immune from unauthorized access or hacking

12.3 Beta and Pre-Release Products

If you purchase or use any beta, alpha, or pre-release version of a Product, you acknowledge that such versions may contain more bugs and are provided without any warranty whatsoever.

13. Limitation of Liability

To the fullest extent permitted by applicable law:
  • OpequeGlass shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses
  • Our total liability for any claim arising out of or relating to these Terms or your use of the Products shall not exceed the amount you paid for the specific Product giving rise to the claim
  • We are not liable for any damages resulting from:
    • Your inability to access or use the Site or Products
    • Any unauthorized access to or alteration of your data
    • Statements or conduct of any third party on the Site
    • Any bugs, viruses, or malware transmitted through the Site or Products
    • Loss of sales, revenue, or business opportunities resulting from Plugin malfunction

14. Indemnification

You agree to indemnify, defend, and hold harmless OpequeGlass, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
  • Your use of the Site or Products
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Your misuse of the License Key or redistribution of the Plugin
  • Any content or data you transmit through the Plugin

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Uganda, EU, and USA, without regard to its conflict of law provisions.

15.2 Informal Resolution

Before filing any formal legal action, you agree to contact us at [support@opequeglass.com] to attempt to resolve the dispute informally. We will make good faith efforts to resolve any dispute within 30 days of receiving notice.

15.3 Arbitration / Jurisdiction

Any dispute arising from these Terms that cannot be resolved informally shall be submitted to:
  • The exclusive jurisdiction of the courts
  • OR binding arbitration in our jurisdiction in accordance with the rules of our abbritration

16. EU Consumer Rights and Digital Content

If you are a consumer resident in the European Economic Area (EEA) or United Kingdom:
  • You have certain statutory rights under EU consumer protection laws
  • As detailed in our Refund Policy, you may waive your 14-day cooling-off period for digital products by consenting to immediate delivery during checkout
  • Nothing in these Terms affects your statutory rights as a consumer that cannot be waived by contract

17. Force Majeure

OpequeGlass shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
  • Acts of God, natural disasters, or extreme weather
  • War, terrorism, riots, or civil unrest
  • Government actions, sanctions, or regulations
  • Internet or telecommunications failures outside our control
  • Failure of third-party services (including Paddle, hosting providers, or licensing servers)

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

19. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision must be in writing and signed by an authorized representative of OpequeGlass.

20. Assignment

You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. OpequeGlass may assign these Terms without restriction. Any attempted assignment in violation of this section shall be null and void.

21. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and OpequeGlass regarding the use of the Site and Products, and supersede all prior agreements, understandings, and representations, whether written or oral.

22. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. Material changes will be communicated by:
  • Posting the updated Terms on this page with a revised "Last Updated" date
  • Sending an email notification to registered users (for material changes)
  • Displaying a prominent notice on the Site
Your continued use of the Site or Products after any changes constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Site and Products.

24. Paddle-Specific Acknowledgments

By purchasing through Paddle, you acknowledge and agree that:
  • Paddle is the Merchant of Record for your transaction
  • Paddle handles payment processing, tax collection, and invoicing independently
  • Paddle's buyer terms apply to the payment aspect of your purchase
  • OpequeGlass is responsible for product delivery, license management, and technical support
  • Disputes regarding payment processing should first be directed to Paddle; disputes regarding product functionality should be directed to OpequeGlass
